Whitaker is primarily a civil litigator licensed in both North Carolina and South Carolina, who focuses in the areas of construction litigation, lien claims, complex business litigation, complex commercial litigation, corporate governance disputes and litigation, planned community disputes and litigation, licensing board complaints, products liability actions, commercial association disputes and litigation, commercial lease disputes, and arbitrations.  Whitaker has successfully tried cases to a verdict in both North Carolina and South Carolina courts.

 

Whitaker has extensive experience as “Project Counsel” for developers and general contractors, which consists of advising those clients during the course of a project when a highly experienced construction law authority and legal partner are needed. His clients utilizing these services understand there is simply no substitute for resolving minor or major issues as they occur, or for building the strongest possible case during construction, instead of at project completion.  The economic benefits and operational enhancements that result from taking this prudent course-of-performance strategy and oversight are numerous. Whitaker knows precisely how to spot the early warning signs of potential disputes and understands the essential research, documentation, investigative strategies and evidence necessary to fortify his client’s position.

Whitaker also has experience in contract negotiation, planned community creation and governance, commercial association governance, corporate creation, and private placement.

 

Whitaker has represented developers, architects, engineers, general contractors, subcontractors, insurance companies, planned community associations, corporate shareholders, members/managers, commercial landlords and tenants, and business owners.

In addition to litigating, Whitaker also serves as a Certified Superior Court Mediator.

 

Prior to joining Rosenwood Rose, Whitaker practiced for several years at two mid-sized law firms in similar practice areas.
