Erik Rosenwood and Nancy Litwak obtained a jury verdict in favor of their client after a seven-day jury trial in Lincoln County in February. Erik and Nancy represented the plaintiff, a bank whose Denver, NC branch had suffered water damage after a sewage incident left the bottom half of the building destroyed. The trial proceeded against the owner of the shopping center in which the bank branch was located, the commercial property manager for the shopping center, and the plumbing contractor responsible for maintaining the shopping center.
The jury found that the defendants were liable for breach of contract and negligence and awarded a $194,000 principal judgment for the plaintiff after more than a week of trial.
